Terms of Service

1. Agreeing to these terms

These terms are an agreement between you and Raeya ("we", "us") for the Raeya iPhone app, Raeya for Mac and raeya.app (together, "Raeya"). By creating an account or using Raeya, you agree to them. Our Privacy Policy and Consumer Health Data Privacy Policy explain how we handle your data.

Name the contracting party (the legal entity or person behind Raeya).

2. The beta

Raeya is in an early beta. Features will change, some may be removed, and things may not always work. Raeya is free during the beta, and we'll tell you before anything costs money.

Confirm the beta is free, and what happens to beta users' data and access if the service changes or ends.

3. Who can use Raeya

You must be 18 or older and live in the United States. Give accurate information when you sign up, keep your sign-in secure, and tell us if you think someone else has used your account. Each account is for one person.

4. Personal use only

Raeya is for understanding your own time. You may not use it to monitor anyone else. Install Raeya for Mac only on a computer that you own or are allowed to monitor. If you use it on a work computer, you're responsible for following your employer's rules. Raeya isn't offered to employers for monitoring employees.

Employee-monitoring laws (New York Civil Rights Law §52-c, Connecticut, Delaware) apply to employers. Confirm this clause is enough to keep Raeya out of scope for personal use on a work computer.

5. Your data

What you put into Raeya, and what Raeya records for you, belongs to you. You give us permission to store and process it only to run Raeya for you, as our Privacy Policy describes. You can delete it, or your whole account, at any time.

6. Not medical advice

Raeya shows sleep, heart and mood data so you can reflect on your days. It isn't a medical device and doesn't diagnose, treat or prevent any condition. Talk to a health professional about your health. In an emergency, call 911. If you're in crisis, call or text 988 (Suicide and Crisis Lifeline).

7. Using Raeya fairly

Don't use Raeya to break the law, try to get into other people's accounts or data, disrupt or overload the service, or copy or reverse engineer it, except where the law allows.

8. Other companies' services

Raeya works with services from other companies, such as Apple, Google and Oura. Their own terms cover your use of them, and we're not responsible for them. If you got Raeya through Apple's App Store or TestFlight, Apple's terms for those also apply, and Apple isn't responsible for Raeya or for supporting it.

Apple requires certain terms in a custom license agreement (or the app uses Apple's standard EULA). Confirm which applies and that this section is consistent with it.

9. Our software

We own Raeya's software, design and name. We give you a personal, non-transferable license to use the apps under these terms. If you send us feedback or ideas, we may use them without owing you anything.

10. Ending your use

You can stop using Raeya and delete your account at any time. We may suspend or close an account that breaks these terms. We may also end the beta or the service; if we do, we'll give you reasonable notice first.

11. Disclaimers

To the extent the law allows, Raeya is provided "as is" and "as available", without warranties of any kind. We don't promise that it will always be available or free of errors, or that its figures, such as time totals or sleep data, are accurate.

12. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits. Our total liability for any claim about Raeya is limited to the greater of what you paid us in the 12 months before the claim, or $50.

Sections 11 and 12: enforceability for consumers, the cap amount, and whether to add an indemnity clause.

13. Changes to these terms

We may update these terms. We'll post changes here with a new date and tell you in advance about significant ones. If you keep using Raeya after they take effect, you accept them.
